Terms of Service
Effective September 4, 2026
These Terms of Service (the “Terms”) govern access to and use of Opening Day HQ, including our websites, team-management tools, league-management tools, applications, and related services (collectively, the “Service”). By creating an account, accepting an invitation, creating or joining a team or league, or otherwise using the Service, you agree to these Terms.
1. Who may use the Service
You must be legally able to enter into these Terms. If you use Opening Day HQ on behalf of a team, league, club, organization, or other entity, you represent that you have authority to act for that organization and to provide the information you submit. Children under 13 should not create their own Opening Day HQ accounts. For youth teams, an adult parent, guardian, coach, manager, or authorized organization representative should manage the account and any information about minors.
2. Accounts and security
You are responsible for the accuracy of your account information, safeguarding your credentials, and activity performed through your account. Do not share passwords or use another person’s account without permission. Tell us promptly if you believe an account has been compromised. We may require email verification, password resets, or other reasonable security steps.
3. Teams, leagues, roles, and administrator authority
Opening Day HQ supports separate team, league, and platform roles. Team owners and managers may control team membership and team data. Commissioners and authorized league staff may control league-owned information such as league seasons, divisions, schedules, standings, registrations, announcements, and league documents. A commissioner role does not automatically grant access to a participating team’s private roster, internal payments, private media, or other team-only information.
If you are an owner, manager, commissioner, administrator, scheduler, scorekeeper, or other privileged user, you are responsible for using that access only for legitimate organizational purposes and for complying with applicable laws, league rules, and permissions from the people whose information you manage.
4. Acceptable use
You may not use the Service to violate law; harass, threaten, exploit, or impersonate others; upload malware; interfere with the Service; attempt unauthorized access; scrape or extract data at unreasonable scale; circumvent permissions or security controls; infringe intellectual-property or privacy rights; or use another team’s or league’s private information without authorization. We may investigate suspected misuse and restrict or suspend access when reasonably necessary to protect users, the Service, or others.
5. Content and data you provide
You retain ownership of content you submit, such as team names, logos, rosters, schedules, statistics, documents, photographs, announcements, and other material (“User Content”). You grant Opening Day HQ a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, display, transmit, resize, and otherwise use User Content only as reasonably necessary to operate, secure, improve, and provide the Service.
You represent that you have the rights and permissions needed to submit User Content, including permission to upload photographs, contact information, roster information, and information about minors when applicable. You are responsible for deciding what information your team or league makes public.
6. Sports information and statistics
Opening Day HQ is a management platform, not a sports governing body. Schedules, standings, statistics, eligibility information, scores, attendance, and other sports data may be entered by users or imported from third parties and can contain mistakes. Teams and leagues remain responsible for official records, eligibility determinations, rules, and competition decisions.
7. Third-party services
The Service may work with third-party providers for hosting, authentication, email, payments, analytics, file storage, or other functionality. Your use of a third-party service may also be subject to that provider’s terms and privacy practices. Opening Day HQ is not responsible for services controlled by third parties.
8. Paid plans, subscriptions, and fees
If paid plans are offered, the applicable checkout or order page will state the price, billing interval, renewal terms, included features, and cancellation terms. Those purchase terms become part of these Terms. Opening Day HQ will not charge a payment method unless a purchase is authorized. Taxes may be added where required. Except where required by law or expressly stated at purchase, fees already paid are not refundable.
9. Service changes and availability
We may add, change, or discontinue features; perform maintenance; impose reasonable limits; or update the Service over time. We aim to provide a reliable Service but do not guarantee uninterrupted or error-free availability. Features identified as beta, preview, experimental, or similar may change or be removed.
10. Suspension and termination
You may stop using the Service at any time. Team or league administrators may remove memberships they control, subject to ownership-transfer requirements. We may suspend or terminate access for material violations of these Terms, security risks, unlawful activity, nonpayment of applicable fees, or conduct that materially harms the Service or other users. Where practical, we will provide notice and a reasonable opportunity to address the issue.
11. Opening Day HQ intellectual property
The Service, software, interfaces, designs, trademarks, logos, and other materials provided by Opening Day HQ—excluding User Content—are owned by Opening Day HQ or its licensors and are protected by applicable intellectual-property laws. These Terms do not transfer ownership of the Service to you.
12. Disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” Opening Day HQ disclaims warranties that are not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
13. Limitation of liability
To the maximum extent permitted by law, Opening Day HQ will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities arising from use of the Service. To the extent liability cannot be excluded, Opening Day HQ’s aggregate liability for claims arising from the Service will not exceed the greater of the amount you paid Opening Day HQ for the Service during the 12 months before the event giving rise to the claim or $100. These limitations do not apply where prohibited by law.
14. Indemnification
To the extent permitted by law, if you use the Service on behalf of a team, league, club, or organization, you agree to defend and indemnify Opening Day HQ from third-party claims arising from your organization’s User Content, misuse of the Service, violation of these Terms, or violation of another person’s rights. This section does not apply to the extent a claim results from Opening Day HQ’s own unlawful conduct.
15. Changes to these Terms
We may update these Terms as the Service evolves. If a change is material, we may provide notice through the Service or require users to accept the new version. The effective date at the top identifies the version currently published.
16. Disputes and applicable law
Before filing a formal claim, you and Opening Day HQ agree to make a reasonable effort to resolve the issue directly. These Terms are governed by applicable law without overriding any consumer protections or other rights that cannot legally be waived. A court with lawful jurisdiction over the parties may hear disputes that cannot be resolved informally.
